Official Rules

State Bank of Cross Plains’ Charity Champion Official Rules

These rules (the “Official Rules”) govern the State Bank of Cross Plains’ Charity Champion 2011 Promotion (the “Promotion”) and set forth the terms and conditions between State Bank of Cross Plains (referred to as “Sponsor”) and each Promotion participant (referred to as “Participant”).  Participation in this Promotion constitutes acceptance of these Official Rules.

1.     The Promotion

The Promotion allows Participants to nominate any eligible 501(c)(3) Dane County non-profit charity from 4/4/11-4/15/11 and to promote from 4/18/11 – 5/18/11.  The top three submissions with the most votes by 5/18/11 will be determined winners.  Winners will be announced on 5/20/11 based on the criteria set forth below.

2.     How to Participate

NO PURCHASE NECESSARY TO PARTICIPATE.

Entry Period: From 9am (C.S.T) 4/4/11 to 1pm (C.S.T) 4/15/11, Participants will have the opportunity to register for the Promotion by correctly completing the entry form to nominate any eligible 501(c)(3) Dane County, Wisconsin Charity at www.statebankcharitychampion.com.  This includes the Participant uploading a picture of his or herself (or that of their immediate family, family member or pet), the name of the person, persons or pet in picture (i.e. Joe, Smith Family, Baby Jane, Sparky the Dog, etc), and the charity they wish to champion.

While we do not discourage the registration of all Dane County non-profits for the promotion, only Dane County 501(c)(3) non-profit charities are eligible for the cash reward.  Sponsor, at its sole discretion, has the right to determine eligibility and reserves the right to modify, disqualify or remove any submission for any reason at anytime whatsoever, including any submission that is not in the “spirit” of the contest, any picture that is copyright protected or fraudulent or is deemed objective to a nominated charity.

Voting Period:  From 9am (C.S.T) 4/18/11 to 10:59 pm (C.S.T) on 5/18/11, Participants and other third parties will have the opportunity to vote on the entries.   Each Participant or third party voter will be allowed up to five (5) votes per day, per I.P. address network.  Sponsor is not responsible for, nor is it required to count incomplete, late, misdirected, damaged, unlawful, illicit votes or votes achieved through automated means or other fraudulent activity. 

Winners will be announced by 5pm (C.S.T.) 5/20/11.

Charities or Participants may be reviewed for eligibility and vetted by an advisory board designated by Sponsor (the “Advisory Board”).  Decisions of the Advisory Board will be binding and conclusive on all matters. 

By participating in this Promotion, each Participant and each Charity grant Sponsor and its affiliated companies a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, unconditional, fully paid right and license: (a) to make, have made, use, copy, reproduce, modify, and create derivative works of any material provided by Participant or Charity through the Promotion (“Submissions”), and (b) to publicly perform or display, import, broadcast, transmit, distribute (directly and indirectly through multiple tiers), license, offer to sell and sell, rent, lease, or lend copies of the Submissions.  Each Participant and Charity consent to the use of his/her name, photographs, videos, voice recordings and likenesses for publicity purposes, as well as any other purpose associated with the Promotion, without additional compensation or permission.  Sponsor reserves the right to remove Submissions as it deems appropriate in its sole discretion. 

3.     Awards

At the end of the voting period, verified winners and the charities they support will be eligible for the following awards based on the sum total of votes received during the voting period by the Participant’s submission.

1st place:  Apple iPad 2* for winner (approximate retail value equals $500) and $1,000 donation to charity in winner’s Submission.

2nd place:  $750 donation to charity in 2nd place winner’s Submission.

3rd place: $500 donation to charity in 3rd place winner’s Submission.

The winners and their charities will be announced on the Promotion website (www.statebankcharitychampion.com), on Sponsor’s Facebook page and on the Sponsor’s corporate website (www.crossplainsbank.com), after an attempt has been made to notify them via private email or other like method on or about 5/19/11.

In the event of a tie, Sponsor may award additional donations as it deems appropriate.  Each winning Charity may be required to provide proof of 501(c)(3) status and Dane County, Wisconsin residence.  The Executive Director of each Charity must be available to speak with Sponsor within five (5) days of Sponsor’s request.  No transfer or assignment of the donation is permitted.  Charities should receive all of their donations 6-8 weeks after Sponsor determines that eligibility requirements and standards have been met.  In the event a winning Charity is disqualified, the donation will be awarded to the eligible Charity receiving the next highest amount of votes; provided they meet all the requirements herein.  Federal, State and Local taxes and fees, if any, are the winning Charity’s sole responsibility. A 1099 tax from will be sent to the 1st place winner in an equivalent amount of the prize awarded.

4.     Eligibility

Open to legal residents of the United States, except employees and directors of the State Bank of Cross Plains. In order to vote, Participant and voters must go to www.statebankcharitychampion.com and follow any subsequent instructions.  Registered Participants must be 18-years-old  and nominated charities must be, 501(c)(3) organizations located in Dane County, Wisconsin and not be subject to any U.S. sanctions.  A Charity that, by itself or through an affiliated entity, discriminates on the basis of race, color, national origin, religion, sex, sexual orientation, disability, age, veteran status, medical condition, citizenship, ancestry or marital status is not eligible.  Other Charities that are ineligible include, but are not limited to, organization designated by the IRS as private foundations, organizations not listed in IRS Publication 78, or organizations otherwise not in alignment with Sponsor’s corporate guidelines. Additional reasons a Charity may be deemed ineligible include, but are not limited to, the Charity and/or its management being subject to any investigation for fraud, financial misconduct or other criminal activity.  Any organization determined to be ineligible at any time will be disqualified.  Sponsor retains the right at its sole discretion to determine eligibility and reserves the right to disqualify any Charity for any reason whatsoever.  All applicable jurisdictional laws and regulations apply.  Void where prohibited or otherwise restricted by law.

The odds of winning will depend on the number of eligible entries received and submitted in accordance with the rules during the submission period and the number of votes cast during the voting period.

5.     Release of Liability

Sponsor, in its sole discretion, reserves the right to suspend, cancel or modify the Promotion without notice or liability if the integrity of the Promotion is compromised in any manner as determined by Sponsor, or if the Promotion is not capable of being conducted as intended by the Sponsor.  Sponsor assumes no responsibility for any loss or damage to Participant’s, Charity’s, or to any other person’s computer relating to, or resulting from, entering or downloading any information software in connection with this Promotion.  Sponsor and its agents are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the Participant or Charity, or by any of the equipment or programming associated with or utilized in this Promotion, or by any human or other errors that may occur in connection with this Promotion.

Participant and Charity release Sponsor, and its parent, affiliates, subsidiaries, officers, directors, agents, employees, and all others associated with the development and execution of this Promotion, from any and all liability with respect to, or in any way arising from, this Promotion, including any suspension, modification or cancellation of the Promotion, and/or acceptance or use of the donation, including liability for personal injury, death, damages or loss.  Sponsor is not responsible for donation quality or utility.

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL SPONSOR BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS.

6.     Warranties and Disclaimers

Participant and Charity represent and warrant that anything submitted through the Promotion does not: (a) infringe on the intellectual property rights of a third party; (b) contain confidential information that violates any obligation of confidentiality; (c) contain any viruses, spyware, malware, or other malicious components that are designed to harm the functionality of a computer in any way; and (d) contain information that is unlawful, inappropriate, slanderous, libelous, defamatory, disparaging, discriminatory, indecent, obscene, hateful or tortuous.

THE PROGRAM MAY CONTAIN TECHNICAL AND OTHER ERRORS AND LIMITATION AND IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND.  SPONSOR DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS OF ANY KIND (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS) AS IT RELATES TO THIS PROMOTION.  THE ENTIRE RISK AS IT RELATES TO THE PROMOTION IS ASSUMED BY PARTCIPANT AND CHARITY.

Title and ownership to Sponsor’s marks, including, but not limited to, trademarks, domain names, logos as well as any other branding element of Sponsor shall remain with Sponsor.  Except as otherwise provided in these Official Rules, no right or license is granted to any third party as it relates to any copyright, patent, or trademark of Sponsor.

7.     Disputes

Except where prohibited, Participant and Charity agree that: (a) any and all disputes, claims and causes of action arising out of or connected with the Promotion or any donation awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Madison, Wisconsin, U.S.A.; (b) all issues and questions concerning these Official Rules and the Promotion shall be governed by and constituted in accordance with the laws of Wisconsin, U.S.A., without giving effect to any choice of law or conflict of law rules.
